AGROTECHNICAL SERVICES, SL (hereinafter AGROTECHNICAL SERVICES), sole and exclusive holder of VIVENCIA Dehesa, offers users the possibility of purchasing products and services offered through this Website. Below you will find the General Terms and Conditions. The general conditions and all steps for online formalization of the process are written in Castilian or English. An electronic copy of the contract between the user and AGROTECHNICAL SERVICES will be filed electronically. A copy will be sent to the email provided by the user at the time of formalizing the contract.
AGROTECHNICAL SERVICES provides the user the necessary technical means to identify and correct errors when entering any information or data, before confirming them.
A) General Information:

B) Acceptance of General Terms and Conditions:
The proper use of the services offered by VIVENCIA DEHESA, and the online purchase of any product or service implies in any event prior acceptance of these General Terms and Conditions.
The formalization of any contract or agreement through this website entails therefore prior reading and acceptance of the General Terms and Conditions set. The customer´s acceptance guarantees that he/she is a person of legal age with ability to formalize an agreement, and that he/she has read and therefore adheres to the provisions therein.
The enjoyment of the rights and obligations deriving from the application of these Terms and Conditions shall continue after contract execution. Any provision herein shall therefore be considered as General Term and Condition, expressly accepted by customers, without prejudice to the conditions of the particular product or service, which may be established and applicable.
It is understood that these Terms and Conditions may not be modified, except that the modification of the same has been expressly agreed in writing by AGROTECHNICAL SERVICES.
Regarding to the cost of the purchased products, it is presumed that the customer accepts the current cost set at the time of the formalization of the contract, according to the current rates that are published on the website.
C) Regulatory and objective Scope of the General Terms and Conditions:
These General Terms and Conditions are intended to regulate all legal relationships which have their origin in the purchase or hiring of products or services made available to its customers by AGROTECHNICAL SERVICES. It is therefore understood that the user accepts the same from the moment that he uses any service or purchases any products or services offered by this entity, subject to the applicable rules and conditions to be established and that apply under nature thereof. These will be made available to the user prior the formalization of any contract.
With respect to the applicable law, the General Terms and Conditions of Contract will be in any case subject to the provisions contained in Law 7/1998, April 13th, on General Contracting Conditions, the Royal Legislative Decree 1/2007 of 16 November, which approves the revised text of the General Law for the Protection of Consumers and Users and other complementary laws, and Law 7/1996 of January 15 of the Retail Trade. Without limiting the foregoing, they may also be subject to Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and Law 34/2002 July 11th, on Information Society Services and Electronic Commerce.
Under the above, customers are informed that these regulations apply to the clauses of general conditions that are part of contracts subject to Spanish law. To complete the registration procedure, the user should follow the successive steps that appear on his/her computer screen, creating a personal, nontransferable password that will allow quick access to their personal data and their status as “User”, both in the case of an individual or a company, without having to complete a new procedure in case he/she wants to access this service again.
The User can modify the information provided at any time by accessing it through the personal password created.

E) Engagement for the purchase of the products offered by VIVENCIA DEHESA (AGROTECHNICAL SERVICES):
AGROTECHNICAL SERVICES guarantees the customer the formalization of the order of the products or services purchased by the price set at the time in which the payment is made.
At the same time, the User guarantees that all data, both for identification purposes and for payment, are true. The User also ensures that he/she is the rightful owner of the means of payment used, or that otherwise he/she has enough power to formalize the payment on behalf of a legal person. In this sense, AGROTECHNICAL SERVICES, reserves the right to institute any legal action to proceed against the User.
The User is responsible for the information provided and therefore agrees to assume all risks inherent in the fact that it is provided through the Internet, notwithstanding that AGROTECHNICAL SERVICES will use all means at its disposal for the protection and guarantee of their confidentiality. Therefore, AGROTECHNICAL SERVICES will be expressly exempted from any fraudulent use by a third party of such data.
By paying the amount set for the purchase of the product/s and/or services chosen, the User agrees to use them at all times in accordance with current regulations and to these Terms.
Nevertheless, AGROTECHNICAL SERVICES, reserves the right to refuse the execution of the contract in the case of considering the User is in breach of any of the above aspects. In this case, shall it be relevant because of the failure of completing the product acquisition, the amount paid will be returned to the customer.
Also, in the case of classroom courses, AGROTECHNICAL SERVICES reserves the right to cancel the course and return the amount paid to the user in case of not reaching a minimum number of attendees.
F) Conclusion of contract between the Parties:
Product and service offers made by AGROTECHNICAL SERVICES through the website www.vivenciadehesa.es shall not be binding until the customer formalizes the order, since both parties being linked to the application of the Terms and Conditions set out herein. Pursuant to the above, the acceptance by AGROTECHNICAL SERVICES of any order placed by the customer shall be effective solely and exclusively from the time of receipt thereof by the company, provided it takes place within the period of validity of the offer and meeting all the requirements.
G) Currency and Taxes:
With regard to the price of purchased products or services, it is understood that the user agrees with them when formalizing the contract, according to current rates at all times, and published in the website.
The prices listed on the website are always displayed in EUROS (taxes included), all the current regulations being applicable at all times.
H) Coverage of the offer:
The products and services offered online by VIVENCIA DEHESA through this website are available for purchase by residents in Spain and abroad.
Prior to the execution of the purchase, the price of shipping costs in each case will be shown.
The following methods of payment will be accepted:
- Paypal: Paypal is a payment processing service that allows you to shop online without having to provide bank details. J) Confirmation of the acquired products and/or services:
After the order is placed and the payment is completed, AGROTECHNICAL SERVICES will send to the email provided by the user supporting evidence of the concluded contract, stating all necessary terms.
K) Right of withdrawal:
To exercise his right of withdrawal, the User may send to the Company the withdrawal document made available on the website. Physical refund of the product will not be possible when withdrawing from a service, within the statutory deadlines for this. Therefore, advance notice is recommended to avoid misunderstandings and expedite all procedures.

The Law establishes a period of 14 calendar days to exercise the right of withdrawal. This period is counted from the signing of the contract (Articles 68-79 and 102-108 of Royal Legislative Decree 1/2007 as amended by Law 3/2014, in force since March 29, 2014). In case of withdrawal, AGROTECHNICAL SERVICES will proceed to refund the amount paid.
ATTENTION: As to the training courses offered, users are informed that the right of withdrawal shall not apply to contracts relating to the provision of services, once the service has been fully performed. In light of the foregoing, the consumer (and user) expressly acknowledges that once the contract has been fully executed he will lose his right of withdrawal. If the User has requested that the provision of services starts during the withdrawal period, a proportional amount considering the already received service shall be paid, considering the time that he communicated his withdrawal, in relation to the total object of the contract. If the user wishes that the service begins during the withdrawal period provided for in Article 104, he/she must therefore make an explicit request to AGROTECHNICAL SERVICES.
In the event that the User exercises the right of withdrawal in the terms established, AGROTECHNICAL SERVICES will refund the product´s price within a period that shall not exceed 14 days from receipt of the product, through the same payment method used.
L) Conditions for carriage and delivery:
When the purchase process is successfully completed, and once AGROTECHNICAL SERVICES confirms the money transfer, (for “Bank Transfer” paid orders), or after receiving the Paypal payment proof, the order will be shipped. If the User has paid for a service, he will receive all necessary information via email.
The User may choose the delivery method: the purchased products will delivered by post or through a courier company, chosen by AGROTECHNICAL SERVICES. Orders are delivered to the address designated by the purchaser in the order process. In view of the above, AGROTECHNICAL SERVICES assumes no responsibility if delivery cannot be made if the information provided is inaccurate or incomplete or if delivery cannot be completed due to the absence of the recipient.
Without limiting the foregoing, AGROTECHNICAL SERVICES will adopt the required measures of a diligent trader so that delivery can be made as soon as possible, satisfying both the sender and the recipient.
AGROTECHNICAL SERVICES guarantees delivery of orders within the period prescribed in the relevant section of the web, given the transport system and the destination chosen by the buyer. On Saturdays and Sundays there is no pickup service and delivery orders, a fact which must be taken into account when calculating deadlines. In special periods (such as Christmas, transport strikes, extraordinary events …), deliveries may suffer some delay.
AGROTECHNICAL SERVICES does not guarantee the delivery at a specific time. If the user designates a specific delivery date, or a preference for a particular time slot, this will be considered only as a guideline. Once and order is placed through the website, the invoice will be included inside the product´s package, and sent to the shipping address provided. If the User wishes to receive and electronic invoice, AGROTECHNICAL SERVICES will send it to the provided email.
Late delivery: AGROTECHNICAL SERVICES shall not be held responsible for loss, damage, withholding or delay in delivery due to causes beyond its control such as acts of God, force majeure or acts that are attributable to the Purchaser. The Parties agree that the following shall be considered force majeure: acts of civil or military authority, fires, strikes, floods, epidemics, wars, riots, transportation delays, restrictions or embargoes imposed by governments or difficulties in obtaining labor, materials, manufacturing facilities or transportation when attributable to such causes. Notwithstanding the foregoing, a delay in delivery above ninety (90) consecutive days, will entitle the buyer to terminate this contract in terms of the undelivered part without any penalty.
Puesta a disposición de la mercancía: En cualquier caso, se entenderá cumplida por AGROTECHNICAL SERVICES la fecha de entrega, siempre y cuando la misma haya sido puesta a disposición del método de envío contratado con suficiente antelación para que, en el marco de unas condiciones no adversas, se estime que el transporte de la misma pueda realizarse adecuadamente.
Provision of goods: In any case, fulfillment of delivery date by AGROTECHNICAL SERVICES shall be deemed provided that the goods have been made available to the selected shipping method well in advance, so that, under non adverse conditions, it would be considered that the delivery can be properly done.
Place of delivery: Orders will be delivered in the chosen address.
Price and offer validity: The price for each product will be the one stated in the Web at the time of placing the order. The price of the order, and the shipping costs, if any may be applicable, shall be paid once the order is completed through the chosen payment method.
All prices are listed in EUROS; VAT included, and apply exclusively for transactions completed through this Website. Prices of listed products not include shipping costs. These will be added in the shopping order, just before checkout, and in those cases where deemed appropriate under these conditions of sale.
Should a typographical error be detected in any of the features or prices, once an order is placed, the user will be immediately informed of this error and the actual price of the product, being entitled to cancel the order if he wishes to do so.
In order to ensure the best delivery, AGROTECHNICAL SERVICES recommends the user to provide a contact phone number where to be contacted if needed. Confirmation of the shipping address is also recommended.

The customer will be allowed 24 hours to verify the integrity of all components of the product, and to verify that it includes all accessories listed on the product page. After that time acceptance on the integrity and product content shall be deemed. This right is independent of the right of withdrawal, which is specified in the relevant section.
M) Ordering Schedule.

Notwithstanding the foregoing, service may be interrupted to perform maintenance tasks. All inquiries or questions via email shall be answered during business hours, as soon as possible.
AGROTECHNICAL SERVICES´s responsibility for any claim shall be in any case limited to the refund of the amount paid by the customer to purchase the product or service. In this sense, and in the broadest extent permitted by law, AGROTECHNICAL SERVICES shall not be liable for any indirect damage, and in particular, for any loss, damage, claims, liabilities, expenses, penalties, general damages, loss of profits or other concept however it may be and whenever it may occur.
O) Integrity and Severability of General Terms and Conditions:
These General Terms and Conditions constitute the entire agreement between the parties. Therefore the parties agree that they are not subject to any other promises, terms, conditions or additional obligations not set out in this document, notwithstanding the modifications contained in the first clause.
The conditions set forth herein are intended to regulate the generic acquisition and online sale, notwithstanding the existence of particular conditions that may be established and applicable to the particular product contracted by the customer.
Should any provision contained herein be declared invalid, the General Terms and Conditions will not be affected and will remain in full force and application, except regarding the particular clause.
P) Server Location, Governing Law and Jurisdiction:
The interpretation of these General Terms and Conditions shall be governed by Spanish legislation.
For all purposes, it will be understood that this Website is located in the headquarters of AGROTECHNICAL SERVICES.
The parties submit, at its option, to resolve conflicts, and renouncing any other jurisdiction, to the courts of the customer´s home.
